These terms govern your use of https://themediagale.com and any services provided by The MediaGale ("TMG Global," "we," "us"). By using this site or engaging us for services, you agree to these terms.

1. Services & engagements

This website describes our development, marketing, analytics, and staffing services at a general level. The specific details, deliverables, timeline, and fees for any engagement are set out in a separate proposal or statement of work, which governs over these terms in the event of a conflict.

2. Acceptable use of this site

You agree not to misuse this website — including attempting to gain unauthorized access to our systems, scraping content for commercial resale, or interfering with its normal operation.

3. Intellectual property

Upon full payment for a project, we assign to you the ownership of the custom work product created specifically for that engagement. We retain ownership of our pre-existing tools, frameworks, internal libraries, and know-how, and may reuse general techniques and non-confidential learnings in work for other clients.

4. Fees & payment

Fees, invoicing schedules, and payment terms are agreed per project. Late payment may result in paused work until the account is brought current.

5. Confidentiality

Each party agrees to keep the other’s non-public business information confidential, using it only to perform under the engagement, and to protect it with the same care it uses for its own confidential information.

6. Warranties & disclaimers

We perform services with reasonable skill and care. Except as expressly agreed in a statement of work, services and this website are provided “as is” without warranties of any kind, including fitness for a particular purpose.

7. Limitation of liability

To the fullest extent permitted by law, neither party will be liable for indirect, incidental, or consequential damages, and each party’s total liability arising from an engagement is limited to the fees paid for the specific project giving rise to the claim.

8. Termination

Either party may terminate an engagement as set out in the applicable statement of work. On termination, you pay for work completed up to that point, and we deliver any completed work product accordingly.

9. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by updating the “Last updated” date above; continued use of the site or an active engagement constitutes acceptance of the updated terms.
